By accessing or using the Luxee platform ("Platform"), including our website, mobile applications, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email or in-app notification.

To use certain features of the Platform, you must create an account. You agree to: - Provide accurate, current, and complete information during registration. - Maintain the security of your account credentials and not share them with third parties. - Notify us immediately of any unauthorised access to your account. - Be responsible for all activity that occurs under your account. You must be at least 18 years old to create an account. Luxee reserves the right to suspend or terminate accounts that violate these Terms.

When you purchase an item on Luxee: - You enter into a binding agreement to purchase the item at the listed price, plus any applicable fees and shipping costs. - All items are subject to our authentication process before being shipped to you. - Risk of loss transfers to you upon delivery by the carrier. - You may request a return in accordance with our Return Policy if the item is not as described or fails authentication. - Luxee acts as an intermediary between buyers and sellers and is not the direct seller of items listed by third-party sellers.

When you list items for sale on Luxee: - You represent and warrant that you have full legal right and authority to sell the item. - You must provide accurate descriptions, photographs, and condition assessments. - All items must be genuine and authentic. Listing counterfeit goods is strictly prohibited and may result in immediate account termination and legal action. - You agree to ship items promptly after a sale is confirmed, in accordance with our shipping guidelines. - Luxee reserves the right to remove any listing that violates our policies.

- Buyers pay the listed price plus applicable shipping and handling fees. - Sellers are charged a commission fee on each successful sale. Current commission rates are available on our Pricing & Fees page. - Seller payouts are processed after the buyer receives and accepts the item, and after the authentication process is complete. - All prices on the Platform are listed in Hong Kong Dollars (HKD) unless otherwise stated. - Payment processing is handled by our third-party payment provider, Stripe. By using our Platform, you also agree to Stripe's terms of service.

Luxee is committed to ensuring the authenticity of every item sold on our Platform. - All items undergo verification by our expert authentication team before being shipped to the buyer. - If an item fails authentication, the sale will be cancelled and the buyer will receive a full refund. - Our Authenticity Guarantee covers items purchased through the Luxee Platform only. - Luxee uses a combination of expert human review and advanced technology to verify authenticity, but we do not guarantee that every counterfeit item will be detected. Our liability is limited as set out in Section 9 below.

The following items may not be listed or sold on Luxee: - Counterfeit, replica, or imitation goods. - Stolen property. - Items that infringe upon intellectual property rights. - Hazardous materials or restricted substances. - Items prohibited by the laws of Hong Kong SAR. - Items not within our accepted categories (luxury fashion, accessories, watches, and jewellery). Luxee reserves the right to determine, at its sole discretion, whether an item violates this policy.

All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of Luxee or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent. By listing items on Luxee, you grant us a non-exclusive, worldwide, royalty-free licence to use your item photos and descriptions for the purpose of operating and promoting the Platform.

To the maximum extent permitted by the laws of Hong Kong SAR: - Luxee provides the Platform on an "as is" and "as available" basis without warranties of any kind, express or implied. - Luxee shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform. - Luxee's total liability for any claim arising from or related to these Terms shall not exceed the fees paid by you to Luxee in the twelve (12) months preceding the claim. - Luxee is not responsible for the conduct of any user on the Platform or the quality, safety, or legality of items listed.

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
